Waste Permit & Planning Applications for Land Improvement Works
Up until 2011 all works associated with land reclamation were regulated by planning legislation. The thresholds that triggered a planning application were so high that in practice the vast majority of reclamation works did not require planning permission and most activity occurred without being subject to any form of assessment. A European Court of Justice ruling however has dramatically changed the situation in terms of assessment of land reclamation activity. Planning permission is now required for drainage and/or reclamation of all wetlands where the area in question is over 0.1 hectares. If the size or nature of the development requires planning permission we can prepare all the required documentation and maps/drawings.
MOL Engineers can also prepare your waste facility permit & certificate of registration application form and associated maps/drawings is accordance with the Waste Management (Facility Permit and Registration) Regulations S.I No. 821 of 2007 and the Waste Management (Facility Permit and Registration) Amendment Regulations S.I No. 86of 2008 (hereafter referred to as the Regulations) where it is proposed to import inert waste material to raise the level of the land above the water table.
